1. About these terms

These terms of use tell you the rules for using the Firmit website at firmit.app (the "site"). By using the site, you accept these terms. If you don't agree, please don't use the site.

We recommend you keep a copy. We may update these terms (see section 11).

2. Who we are and how to contact us

The site is operated by Firmit Technologies Ltd ("Firmit", "we", "us"), a company registered in England & Wales (company number 17313142), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. Contact us at admin@firmit.app.

3. These terms vs. using the Firmit service

These terms cover using the website. If you sign up to use Firmit as a business, or pay a business through Firmit as a customer, separate terms apply to that:

  • Businesses are governed by our Platform Terms - the agreement you accept when you sign up to use Firmit;

  • Customers paying through Firmit are governed by the Customer Terms shown at checkout.

Where those terms cover something also mentioned here, they take precedence for that activity. How we use personal data is explained in our Privacy Policy and Cookie Policy.

4. Using the site

You may use the site for lawful, personal or business-information purposes. You must not:

  • use the site in any unlawful or fraudulent way, or for any harmful purpose;

  • copy, scrape, republish, sell, or exploit the site or its content except as allowed below;

  • attempt to gain unauthorised access to the site, its servers, or any connected system;

  • introduce viruses or other malicious code, or attack the site (including denial-of-service attacks);

  • misuse the site in a way that damages it, disrupts it, or degrades it for others.

We may withdraw or suspend your access if you break these terms, and we may report serious breaches to the authorities.

5. Our content and intellectual property

We own or licence all intellectual property in the site and its content (text, graphics, logos, "Firmit" branding, layout, and software). It's protected by copyright, trade marks, and other laws.

You may view, and print or download extracts of, site content for your own information or legitimate business use, provided you don't modify it or remove any notices, and you don't use it commercially without our permission. You must not use our name, logo, or trade marks without our written consent. All rights not expressly granted are reserved.

6. No reliance on information

The content on the site is provided for general information only. It isn't advice (legal, financial, or otherwise) you should rely on, and it may not always be complete or up to date. Before acting on anything on the site, get appropriate professional advice. Any pricing, features, or product descriptions may change, and marketing statements about Firmit are subject to the actual service terms.

7. Links to and from the site

Where the site links to third-party sites or resources, those are provided for convenience only - we don't control them and aren't responsible for their content. You may link to our home page fairly and lawfully in a way that doesn't damage our reputation or suggest an association or endorsement that doesn't exist. We may withdraw linking permission at any time.

8. Availability

We don't guarantee the site will always be available or uninterrupted. We may suspend, withdraw, or change all or part of the site for business or operational reasons, and we won't always give notice. You're responsible for arranging your own access to the site and for making sure anyone accessing it through your connection knows these terms.

9. Our responsibility for loss or damage

We provide the site with reasonable care, but to the extent permitted by law we exclude the following in connection with your use of the site:

  • liability for indirect or consequential loss;

  • liability for loss of profit, revenue, business, goodwill, or data;

  • liability for content on the site being inaccurate or incomplete;

  • liability for loss or damage from a virus or harmful material you get from the site or a linked site (you're responsible for your own security software).

We do not exclude or limit our liability where it would be unlawful to do so - including liability for death or personal injury caused by our negligence, for fraud, or (if you're a consumer) any statutory rights that can't be excluded. If you're a consumer, you have legal rights that these terms don't affect.

Nothing here limits any obligations we owe you under the Platform Terms, Customer Terms, or the Privacy Policy - those govern the service and your data.

10. Your information

Any personal data we collect through the site is handled in line with our Privacy Policy, and cookies as described in our Cookie Policy.

11. Changes to the site and these terms

We may update the site's content and these terms at any time. Please check this page from time to time - the "last updated" date shows when we last changed them. Continuing to use the site after a change means you accept the updated terms.

12. Law and jurisdiction

These terms, their subject matter, and their formation are governed by the law of England & Wales. The courts of England & Wales have jurisdiction, except that if you're a consumer resident elsewhere in the UK you may also bring proceedings in your home nation.

13. General

If any part of these terms is found unenforceable, the rest continues to apply. We may transfer our rights and obligations under these terms (for example, on a sale or reorganisation of the business). These terms are between you and us; no one else has rights to enforce them.
